In line with the new EU Directive of June 23, 2011 for the protection of online shoppers: the directive will be transposed into Italian law by 2013 and Amoflex already meets the new consumer protection standards. The consumer has the right to withdraw from any distance contract, without penalty and without specifying the reason, within the period of 14 working days starting from the day of delivery to the consumer. The right of withdrawal is exercised by sending written notice to Amoflex sas By the deadline. The consumer may not exercise the right of withdrawal for contracts for the supply of any non-prefabricated goods produced on the basis of an individual consumer choice, the current legal wording states that the right of withdrawal cannot be exercised for “custom-made or clearly customized goods.” The right of withdrawal cannot be exercised for those products that provide for strictly personal use such as mattresses, pillows, comforters and blankets, table and bed linens and the like, if the protective cellophane is no longer sealed or the product has been washed or used. The right of withdrawal is also not exercisable on non-personalized goods in the following cases: goods purchased with a VAT number for professional purposes; goods included in contracts negotiated at the headquarters of Amoflex sas and finally concluded by placing the order online “at a distance”. By exercising the right of withdrawal on a single product whose value allowed the activation of the Free Shipping promotion within a larger supply, the promotion will no longer apply; in this case, the order’s shipping costs will be charged to the consumer as per the tariff. The consumer is required to return the goods at his or her own expense to Amoflex sas within 14 working days of exercising the right of withdrawal; in addition, the goods must have been used with normal diligence, must not have been damaged and must be returned in their original packaging. 

If the right of withdrawal is exercised by the consumer in accordance with the provisions herein, Amoflex sas will refund the amount paid except for the additional costs that the Customer has expressly confirmed in addition to Standard Delivery. Refunds are promptly made within 10 working days from the time Amoflex sas becomes aware of the buyer’s bank details, However, after the goods are received at our warehouses and checked for perfect condition. In the event that the consumer does not comply with the terms and conditions for exercising the right of withdrawal Amoflex sas will not be able to refund any amount: instead, we may return the goods at the consumer’s expense.
